HIPAA Compliance after the Stimulus Package: Including Medical Records and the Final Privacy and Security Rules

For all health care organizations, managers and key personnel of both covered entities, and now also business associates, medical record confidentiality has become a critically important management issue. With HIPAA, the final DHHS privacy and security regulations, and now the Stimulus Package, the responsibility for increased security and sensitivity in the maintenance and transmission of health information will be monumentally greater. And now, the new Stimulus Package dramatically increases penalties for failure to do so and makes the law apply to business associates, as well.
In this seminar, the existing federal and state laws involving electronic health record confidentiality, privacy, and security, coupled with the new laws, are thoroughly explained by a nationally recognized electronic health records, privacy and security law expert. Participants will receive practical legal guidance on drafting policies and procedures, as well as a complete compliance manual that will be utilized during the seminar.

ABOUT THE PRESENTER
JONATHAN P. TOMES, J.D., is a health care attorney practicing in the greater Kansas City area as a partner in the law firm of TOMES & DVORAK. He has served as an Associate Professor of Law with the IIT Chicago-Kent College of Law and as a military judge in the U.S. Army Judge Advocate General's Corps. Before becoming a military lawyer, Mr. Tomes learned about security systems in the Military Intelligence branch of the Army.
His works have appeared nationally. His books include the following: The Compliance Guide to HIPAA and the DHHS Regulations (4th edition forthcoming), Veterans Press; Electronic Health Records: A Practical Compliance Guide, Veterans Press; Compliance Guide to Electronic Health Records, Faulkner & Gray; Healthcare Privacy and Confidentiality, McGraw Hill; Healthcare Records: A Complete Guide, Warren, Gorham & Lamont; and more than 40 others.
Recent articles include "Individual Criminal Liability for HIPAA Violations: Who Is Potentially Liable? Or Should We Say, Who Isn't?" Recently, he has been an expert witness in litigation involving health information compliance issues. Mr. Tomes is a member of the bar of the U.S. Supreme Court, the federal 7th Circuit, 8th Circuit, and 10th Circuit Courts of Appeal, and Illinois, Missouri, Kansas, and Oklahoma, including their respective federal courts. He is also the President of EMR Legal, Inc., a national HIPAA consulting firm, and, as such, is uniquely qualified to teach how to comply with HIPAA, the regulations implementing it, and the changes that the new Stimulus Package requires regarding HIPAA. His knowledge of the law and of the practical aspects of setting up a security system provides a rare opportunity for medical records veterans and novices alike.
